There are very limited number of ways to immigrate to the United States. One of the most common ways is applying for a family visa. The other well-known way is through employment visa. The employment category further has varied categories named EB-2, EB-3, EB-4 immigrant visas.

To obtain the labor certification, PERM is a system that is used to get the employment visa. In this blog, we will discuss the various processes, requirements and steps that are taken to obtain the labor certification.

Overview-

PERM stands for Program Electronic Review Management. It is a system used to process labor certifications. On 28 March in 2005, PERM was first executed.

Since then, all labor certification applications are required to be filed with PERM. It is the first step through which you can apply for a visa under the EB-2 (with the exception of National Interest Waivers) and EB-3.

Process-

The processing period of PERM is about 4–6 months. It is a 3 step process that needs a number of requirements which are important to obtain a permanent residency in the United States. Under this process, the petitioning employer conducts a number of recruitment steps that check the requirement of the applicant.

The PERM application can proceed on Form ETA 9089. In this, the employer will make attestations about the requirement.

If the application is picked for audit, then the employer has to provide sufficient evidence to DOL that supports the attestations made on the labor certification. The employer receives a confirmation email from DOL if the application is submitted.

Although this process is linked to immigration but still it is not directed by the U.S. Citizenship and Immigration Services (USCIS). Moreover, it is managed by the Department of Labor (DOL). DOL is an agency that works to protect the rights of U.S. workforce.

Once the application is approved, the employer receives a confirmation email from DOL. After this employer can proceed to next steps which are managed by the USCIS.

Requirements-

This labor certification process needs an employer to explain the job description and minimum requirements for the position. The employee must fulfill the minimum requirement (education, experience, particular skill) that is actually required for that position.

Other requirements and preferences are given to the applicants who have skills like good communication, organized, team player, fits with the company culture. It is extremely important for the employer and employee to understand the minimum requirements and how these requirements relate to the day-to-day job duties.
